Mirath, which translates to inheritance, is the comprehensive Islamic system of transferring the ownership of a deceased person’s property, rights, and assets to their legitimate heirs according to the divinely ordained rules of the "Shariah." While "Fara’id" refers to the specific science of the fixed shares, Mirath encompasses the broader legal and ethical framework of the entire process, including the payment of debts, the fulfillment of valid wills (Wasiyyah), and the final distribution of the estate. The purpose of the system of Mirath is to prevent the concentration of wealth in a single hand and to ensure that the resources of the deceased continue to provide "Barakah" (blessing) for their family and the community.
Theologically, Mirath is a reminder of the fleeting nature of the "Dunya" (the material world) and the absolute ownership of Allah (SWT) over all things. The Quran states: "To Allah belongs the inheritance of the heavens and the earth" (Surah Ali 'Imran 3:180). This system is a manifestation of Divine "Adl" (justice), as it recognizes the different roles and responsibilities within the family structure. The distribution is designed to strengthen the bonds of "Ukhuwwah" (brotherhood) and to provide "Aman" (security) for the survivors. By following the laws of Mirath, the believer practices "Ikhlas" (sincerity) and "Taqwa" (God-consciousness), ensuring that their wealth does not become a source of "Fasad" (corruption) or conflict after their death. The Prophet Muhammad (PBUH) emphasized the importance of learning this science, as it is the "first thing to be forgotten" of the religion. It teaches the believer that their life and their wealth are an "Amanah" (trust) that must be returned to the Creator according to His specific instructions. Mirath provides the soul with a sense of "Rida" (contentment), knowing that their legacy will be managed with integrity and fairness.
For the Ummah, the system of Mirath is essential for maintaining social order and the protection of private property. It teaches the believers the value of responsibility and the importance of planning for the future with a spiritual perspective. In the modern world, the Islamic laws of inheritance offer a robust and fair alternative to secular systems, providing a clear and respected path for millions of people. It encourages a culture of "Ilm" (knowledge) and mutual support. By honoring the principles of Mirath, the Muslim community demonstrates the practical wisdom of the "Sunnah" in creating a just and compassionate society. It remains a vital part of the Islamic identity, guiding the believers to value the "Path of Success" in both large and small affairs, ensuring that the light of Divine justice continues to guide the human condition toward eternal harmony.
