Qisas, or "Equitable Retaliation," refers to the Islamic legal principle of "just retribution" in cases of intentional physical harm or homicide, based on the Quranic rule of "a life for a life, an eye for an eye." However, while the law allows for a reciprocal punishment, the Quran strongly encourages the victim or their heirs to choose "Afw" (forgiveness) or "Diyah" (compensation) instead. The primary objective of Qisas is to serve as a powerful "Zajir" (deterrent) against violence and to protect the "Maqasid al-Shariah" (higher objectives), specifically the sanctity of life and public order. Allah (SWT) states: "And there is for you in legal retribution [saving of] life, O you of understanding" (Surah Al-Baqarah 2:179).
Theologically, Qisas is a manifestation of Allah’s absolute "Adl" (justice) and His role as the "Hakim" (The Judge). It teaches the believer that every action has an equal and opposite consequence, and that human life is too sacred to be violated without a severe response. By establishing a strictly regulated and fair system of retribution, the "Shariah" prevents the "Fitna" (trial) of tribal feuds and private vengeance that characterized pre-Islamic society. Qisas provides "Aman" (security) and "Sakina" (tranquility) by ensuring that the law is the ultimate arbiter of grievances. However, the divine preference for mercy (Afw) highlights the "Ihsan" (excellence) of the Islamic path, encouraging the believer to "overcome evil with good." This balance between "justice" and "mercy" is the "Middle Way" that characterizes the "Ummatan Wasatan." It teaches the believers that while they have a right to justice, the higher spiritual success is found in forgiveness for the sake of Allah. Qisas reflects the "Hikmah" (wisdom) of the Creator in providing a legal framework that is both firm in its deterrent and soft in its potential for healing.
