Wilayat al-Faqih (Guardianship of the Jurist) is a political doctrine in Twelver Shia Islam that argues that in the absence of the infallible Imam (the Hidden Imam), the most just and knowledgeable Islamic jurist (faqih) holds authority over the political and religious affairs of the community. The doctrine was developed and systematized by Ayatollah Ruhollah Khomeini (1902-1989) in a series of lectures in Najaf (1970) published as "Islamic Government." Khomeini argued that since Islamic law requires a just government for its implementation, and since the Hidden Imam is in occultation, the responsibility for governance devolves to those most qualified to interpret and apply Islamic law-the fuqaha (jurists). The doctrine holds that the faqih must possess two essential qualities: 'adalah (justice) and knowledge of Islamic law (fiqh). The wilayah (guardianship) encompasses both political governance and religious authority. According to Khomeini's formulation, the Wali al-Faqih (Guardian Jurist) has ultimate authority over all branches of government and may overrule elected bodies when necessary to protect Islam. The doctrine was implemented after the 1979 Iranian Revolution, with Khomeini serving as the first Wali al-Faqih. The 1979 Constitution of Iran institutionalized the doctrine, establishing the position of Supreme Leader (Rahbar) as the country's highest authority. The doctrine has been debated among Shia scholars. Some support Khomeini's broad interpretation (al-wilayat al-mutlaqa, absolute guardianship), while others advocate a more limited role for jurists, restricted to oversight and ensuring that legislation does not contradict Islamic law. Critics within Shia seminaries, such as Grand Ayatollahs like Muhammad Shirazi and others, have offered alternative interpretations. For Muslims, Wilayat al-Faqih represents a distinctive Shia model of Islamic governance, combining religious authority and political power in the person of the supreme jurist. The doctrine continues to shape Iranian politics and influence Shia political thought globally, while its implementation and interpretation remain subjects of ongoing discussion and debate within Shia seminaries and beyond.
